General Terms & Conditions of Scars & Stars B.V. operating under the artist name YVESKE

1. Scope of Application

These General Terms and Conditions (GTC) govern all transactions between Scars & Stars B.V. and its customers, who purchase products or services through the online presence of the artist name YVESKE.

2. Contractual Agreement

The contract is concluded with Scars & Stars B.V. The presentation of our products online is a non-binding invitation to you to order products. By submitting your order, you make a binding offer to conclude a purchase contract. You will receive an acknowledgment of receipt of your order by email. However, the purchase contract is only concluded when we expressly confirm the acceptance of your offer via email or by shipping the goods.

3. Delivery Conditions

Delivery of products will be made to the address specified by the customer, with shipping fees applicable as displayed at checkout. Since products are largely made to order, delivery times may vary, and specific information will be provided with the order confirmation. International customers are responsible for any customs duties or taxes.

4. Payment

Payment can be made via credit card, PayPal, or iDEAL. Payment must be completed at the time of purchase. Given the custom nature of many of our products, payment confirms the start of production.

5. Property Rights

The products remain the property of Scars & Stars B.V. until full payment is received.

6. Warranty

The statutory warranty rights apply. Any additional guarantees will be specified in the product description if applicable.

7. Liability

Liability for damages caused by slight negligence is excluded, except for damages resulting from injury to life, body, or health, or breaches of essential contractual obligations. Essential contractual obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely.

8. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which consumers can find at http://ec.europa.eu/consumers/odr/. Scars & Stars B.V. is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

Cancellation Policy

Given that our products are largely made to order, we cannot accept cancellations once an order has been placed and production has commenced. We encourage customers to review their orders carefully before submission.

Shipping Terms

All standard shipping costs and times will be clearly outlined on our website. Please note that as our products are largely made to order, dispatch times may be longer than standard. Customers will be informed of the expected delivery timeframe during the ordering process.Backorders are charged immediately and dispatched as soon as they become available. You will receive an email with tracking information once your order has been shipped.Please be aware that we do not accept P.O. Box addresses for delivery.

Delivery Timeframes

Due to the custom nature of our products, which are made to order, please allow additional time for dispatch and delivery. Customers will be notified of specific delivery timescales when placing an order. This adjustment ensures that we provide accurate delivery expectations in line with the bespoke creation of our items.

Payment

All listed prices include sales tax unless otherwise stated. For deliveries outside the EU, national taxes and import duties may apply. We accept payments via credit card (AMEX, Mastercard, Visa), Apple Pay, Shopify Pay, and PayPal.

Changes to Your Order

We understand the importance of your order and encourage you to review it carefully before submission. Given the custom nature of our products, changes or cancellations after the order has been placed are not possible. If your parcel has already been shipped and you need to change the shipping address, please contact the local delivery company once the parcel arrives in the destination country.

Store Returns

We offer refunds with a valid receipt and the original packaging intact within 14 days from the date of receipt for non-customized products. For products made to order, we cannot accept returns unless they are defective or damaged. We accept exchanges or store credit for current titles returned in their original packaging. No refunds or exchanges are offered for discounted or opened items.

Online Returns Policy

For our custom-made products, we cannot offer a standard right to cancel the purchase within 14 days of delivery. However, if you receive a product that is defective or damaged, please contact us at hello@yveske.com to arrange for a return or exchange. Please note that online purchases cannot be returned to any of our physical stores.
